The 5th U.S. Circuit Court of Appeals ruled that mifepristone must be distributed only in person and at clinics. This decision affects all states, including those without abortion restrictions. In 2023, the FDA permanently lifted the in-person dispensing requirement for mifepristone, allowing it to be sent by mail.

Mifepristone was approved in 2000 as a safe and effective way to end early pregnancies. Surveys indicate that the majority of abortions in the U.S. are administered using pills, with about one in four prescribed via telehealth. In Louisiana alone, over 9,350 abortions were provided via telehealth in 2025.

This ruling is viewed as a significant threat to abortion access since the Supreme Court overturned Roe v. Wade in 2022. The decision came in response to a lawsuit from Louisiana against the FDA regarding mifepristone distribution.

Experts express concern about the implications of this ruling. Josh Thorburn stated, “This is a huge access issue for patients that haven’t got providers close by, or providers close by who are willing to prescribe.” Kelly Baden warned that if allowed to stand, it would severely restrict access to mifepristone everywhere.

Julia Kaye emphasized that politicians have made it harder for people across the country to obtain a medication used safely for over 25 years. Mary Ziegler noted that this change could significantly alter how people experience abortion access.

The next steps remain uncertain as Danco Laboratories plans to appeal this decision. Observers expect further legal action as this case progresses through the courts.
